The 95 Agency LLC operates as a business and we expect clients to understand and respect our policies. Our goal as a full marketing, management and development company is to bring the highest value per dollar spent by our clients, and in order to help us in that pursuit, we need to cover expenses and fuel our operations. Therefore, we require payments to be made on-time in respect to the services offered to our clients.

We understand that sometimes “life happens” and you may need a refund on fees paid for services to The 95 Agency We try to be fair, and create a policy that is a win-win for both parties. We will work with you to make you satisfied with our work. However, there is NO REFUND on work started or completed. 

Requests for the final portion of payment due on all projects are not made until the project receives final approval from the client. Final payment is due immediately. Files or website will not be transferred to client until final payment is done.

By signing up for our services you acknowledge that you have read and understand this Agreement and agree to be bound by its terms and conditions.

General Refund Policy Guidelines

All Design Services (Packaging, Website, Marketing & More)

Web design and development projects require extensive resources, consumes our time and incurs internal expenses. Therefore once a payment or deposit is made, it is non-refundable. Payments for custom design projects (i.e. custom logo designs and branding projects, full website designs, individual page mockups and smaller design components within a website, social media marketing materials, advertising designs, etc.) and custom development projects (i.e. php programming, WordPress CMS custom development, WordPress Plugin custom development, etc.) are made to us in the two increments or paid in full, but if a project gets cancelled, delayed or postponed by the client, then all monies paid will be retained by The 95 Agency LLC and if applicable, an additional cost will be charged to the client for all work completed beyond what was already paid for shall be paid by the client. All projects that are started or completed as defined as the scope of the work are non-refundable.

 

Photography and Videography Policy

In the case of camera failure, inclement weather, or any other unforeseen incident that prevents The 95 Agency LLC from shooting on a scheduled date a new date will be scheduled or client will be refund of their deposit, if applicable.

No refund will be given under any circumstances if you fail to attend the activity on the day and at the time listed, when the booking was made.

Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned; The 95 Agency LLC has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the buyer selected and paid for the photo and then The 95 Agency LLC has sent the buyer the correct photograph) it is then considered non-refundable. If a buyer has selected and purchase an incorrect photo, he/she must notify The 95 Agency LLC, before receiving the “incorrect” photograph.

Refunds will NOT be given due to “not liking a photo”, selecting an incorrect photo after the buyer has already received the photograph, or any other reason. If a mistaken photo is sent to the buyer, as documented on the invoice, The 95 Agency LLC will send the correct photo to the buyer free of charge.

 

The 95 Agency LLC has a STRICT No Refund Policy on product photography, commercial photography and film projects. 

Product Development Policy 
There is a STRICT  NO REFUND POLICY on product development services. Please see contract for all terms and conditions. 

Logo Design

Fees regarding your logo design are only refundable prior to your consultation with a The 95 Agency. Since the logo fee is entirely based on the The 95 Agency’s knowledge, expertise and time, once you have had your design consultation the amount that can be refunded will be based entirely on the amount of time spent and work completed.

Print Products

Design fees for print projects are only refundable prior to the consultation, or the scheduled start date in cases that do not require a consultation.

Projects with hourly design rates may be refunded post-consultation less any hours consumed prior to the cancellation request.

Production costs paid to The 95 Agency LLC are only refundable prior to Approval. If it is determined that a production error* has occurred, claims made within 30 days of your “In Production” notification will be replaced at no cost. This determination will be made at the discretion of BrandCo and the associated vendor upon receiving evidence of the damages/error. Rush shipping fees are non-refundable.

*Production errors do not include graphical elements on approved artwork (i.e. typos, incorrect information, color choice, fonts or imagery).We are not responsible or liable for any errors on printed work who’s files were created by an outside design company.

Clients Missing in Action

If you do not communicate with The 95 Agency LLC for a period of 90 consecutive days during any part of the design or development process, The 95 Agency LLC will honor its commitment to finish the project, but there will be no refund of any fees.
